Terms and Conditions
This document is a guide detailing the operating procedures, terms and conditions pertaining to the engagement of the services of Marcus John Schmidt, trading as Marcus John | Media and Design.
This document is subject to the addition and amendments of clauses over time. These clauses may change without explicit notice, in which case the version of the document signed by or initially approved by the viewer/client upon commencement of work shall, for legal purposes, be the recognised document upon which the terms of the specific job were agreed.
2. Billing
2.1. Hourly Work
The engagement of services performed under an hourly, half-daily or daily basis is subject to approval from both parties, which may be written or verbal, and requires the agreement of a rate of pay*. The rate of pay may be job specific, or subject to change at any point in time, except for throughout the duration of a job. The rate of pay may be affected by economic, environmental, financial, or personal factors, all of which are at the discretion of the contractor. Work will not commence unless there has been written and dated communications sent from either party pertaining to the job requested. By default, any written communications can serve as approval to begin work under the expectation that they are following verbal communications or other arrangements organised between parties.

*As of March 2023, the base hourly rate is charged at 50.00 AUD, half-days are charged at 250.00 AUD, and full days at 400.00 AUD. As of this point in time, Marcus John | Media and Design is not required to withhold GST.
2.2. Quoted Work
The engagement of services quoted per project is strictly subject to verbal or written approval from both parties during an initial consultation. Consultation may take place in-person or by virtual means and requires at a minimum an informal acknowledgement of both parties’ intent to commit to working together. Prior to commencement of work, a written quote will be drafted detailing deliverables, costings, and payment intervals, which will be required to be signed by both parties, while acknowledging agreement to the terms and conditions.

3. Copyright
Any assets produced are the property of Marcus John | Media and Design unless explicitly agreed otherwise. In some situations, products and assets may be licenced. By default, the purchase and use of a licenced design from Marcus John | Media and Design entitles 20 years of personal use and does not cover the resale of that product or design to third parties for personal gain or profit. Any breaches of copyright use will be investigated and legal action will be taken against any/all perpetrators.
Any documents (including this one) owned or published by Marcus John | Media and Design are considered original and are property of the company, meaning they too are protected under copyright law.
4. Summary
Generally speaking, I’m very laid back but I really don’t appreciate people taking the piss. If for any reason you don’t see us working well together, please bring this up early so we can talk through it and try to find a workaround. Any qualms, queries or questions can be answered via phone or email. This is version 1.0 of the T’s and C’s so any feedback would be a great help.
